Kalakari LLC

Terms of Service

Acceptance of these terms

By using the Site or engaging Kalakari for a custom piece, you agree to these Terms and to our Privacy Policy. If you are agreeing on behalf of another person or an entity, you represent that you are authorized to do so.

Who we are

The Site and its services are operated by Kalakari LLC, a Texas limited liability company. You can reach us at hello@kalakarijewelry.com.

Custom orders and consultations

Kalakari designs and produces made-to-order fine jewelry. A project typically begins with a conversation, followed by design, materials selection, CAD approval, production, and delivery. Nothing on the Site is an offer to sell a specific item at a specific price; an order exists only once we and you have agreed in writing (including by email) on the design, specifications, price, and payment terms for your piece.

Kalakari works with a network of workshops, artisans, and stone suppliers, primarily in India, and reserves the right to select, change, or add manufacturing and fulfillment partners at our discretion, without notice, provided the agreed specifications for your piece are met.

Quotes and pricing

Quotes are based on the specifications discussed and on precious-metal and stone prices at the time of the quote. Because those prices move, a quote is valid only for the period we state (or, if none is stated, for 14 days). Significant changes you request to the design, metal, or stones may change the price, and we will confirm any change with you before proceeding.

Payment and deposits

Unless we agree otherwise in writing, custom projects require a non-refundable deposit before design work and material procurement begin, with the balance due before the finished piece ships. Payments are processed through our third-party payment provider; we do not store full payment card numbers. Title to the piece passes to you only upon receipt of payment in full.

All sales final; no returns

Because every piece is made specifically for you, all sales are final and no returns, exchanges, or refunds are offered once production has begun. We reduce this risk by reviewing every detail — design, measurements, metal, and stones — with you and by obtaining your written approval of the CAD design before production. If we make an error against the agreed specifications, we will correct it at no charge.

Production timelines

Production timelines we provide are good-faith estimates, not guarantees. Custom fabrication, stone sourcing, customs clearance, and shipping carriers can all affect delivery. We are not liable for delays outside our reasonable control.

Materials, stones, and certification

We most commonly use GIA- or IGI-certified stones, and occasionally stones certified by other recognized independent labs (such as HRD or GCAL), where certification is available; we will share grading documentation for center stones. Natural materials and our custom production process mean slight variations in color, inclusions, finish, and measurements are normal and are not defects. Lab-grown and natural diamonds are disclosed as such.

Shipping and risk of loss

Finished pieces ship within the United States via a reputable, insured carrier selected to balance security and timely delivery — typically UPS or USPS — with tracking and signature required on delivery. Risk of loss passes to you upon delivery to the address you provide. Please make sure your shipping address is correct and that someone can sign for the package; we are not responsible for loss or theft after carrier-confirmed delivery.

Photos, videos, and content you share with us

If you send us reference images, videos, inspiration, or other content, you represent that you have the right to share it, and you keep ownership of it. Kalakari reserves the right to photograph and film finished pieces, and to use those photos, videos, and any content or story you share with us, on our website, social media, and other marketing. If you would prefer we not use your photos, videos, or story, or want us to stop using them, let us know in writing (email is fine) and we will honor that going forward.

Our intellectual property

The Site and its content — text, photography, video, graphics, the Kalakari name and logo, and original design work — are owned by Kalakari LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or use them without our written permission, except for personal, non-commercial viewing of the Site.

Acceptable use of the Site

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping content at scale, or using it in violation of any law. We may suspend access for conduct that harms the Site or other users.

Disclaimers

The Site and its content are provided "as is" and "as available." Educational articles on the Site are general information, not professional appraisal, financial, or legal advice. To the fullest extent permitted by law, Kalakari disclaims all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Kalakari LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or relating to the Site or a project. Our total liability for any claim relating to a piece will not exceed the amount you paid us for that piece.

Indemnification

You agree to indemnify and hold harmless Kalakari LLC and its owners from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction. Before filing anything, you agree to first contact us at hello@kalakarijewelry.com so we can try to resolve the matter.

General terms

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms, together with any written project agreement and our Privacy Policy, are the entire agreement between us. We may update these Terms by posting a revised version with a new "Last updated" date.
